1. Acceptance of Terms

By accessing or placing an order through the KFC Nassau ecommerce website or mobile application (the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Platform. These Terms apply to all visitors, users, and customers.

2. About Us

The Platform is operated by Restaurants Bahamas Ltd. ("we", "us", "our"), the authorized operator of KFC restaurants in Nassau, The Bahamas. KFC is a registered trademark of Yum! Brands, Inc., used under license.

3. Eligibility

You must be at least 18 years of age to place an order on the Platform. By using the Platform, you represent that you meet this age requirement and have the legal capacity to enter into a binding agreement.

4. Account Registration

• You may be required to create an account to place orders. You are responsible for maintaining the confidentiality of your login credentials.

• You agree to provide accurate, current, and complete information during registration.

• You must notify us immediately of any unauthorized use of your account.

• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Orders & Payment

• All orders are subject to availability and confirmation.

• Prices displayed on the Platform are in Bahamian Dollars (BSD) and are inclusive of applicable taxes unless stated otherwise.

• We accept major credit/debit cards and any other payment methods displayed at checkout.

• Once an order is confirmed, it cannot be modified. Cancellations may only be requested before the order has been accepted by the restaurant.

• We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud or pricing errors.

6. Delivery

• Delivery is available within designated zones in Nassau, Bahamas. Delivery areas are shown at checkout.

• Estimated delivery times are provided as a guide only. We are not liable for delays caused by traffic, weather, or other circumstances beyond our control.

• A delivery fee may apply and will be displayed before you confirm your order.

• You are responsible for providing accurate delivery address information. We are not liable for failed deliveries due to incorrect addresses.

7. Refunds & Complaints

• If your order arrives incorrect, incomplete, or of unsatisfactory quality, please contact us within 2 hours of delivery.

• Refunds or replacements are issued at our discretion following investigation.

• We do not offer refunds for change of mind after an order has been prepared.

8. Promotions & Discounts

• Promotional codes and discounts are subject to specific terms, expiry dates, and availability.

• Only one promotional code may be applied per order unless stated otherwise.

• We reserve the right to withdraw or modify promotions at any time without notice.

• Promotions cannot be exchanged for cash.

9. Intellectual Property

All content on the Platform, including logos, images, text, and design, is the property of Restaurants Bahamas Ltd. or its licensors. You may not reproduce, distribute, or use any content without our prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, Restaurants Bahamas Ltd. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform or any order placed through it. Our total liability to you shall not exceed the value of the order in question.

Nothing in these Terms limits or excludes your statutory rights as a consumer under the Consumer Protection Act (No. 10 of 2023) or any other applicable law of The Commonwealth of The Bahamas. Your statutory rights are not affected by these Terms.

11. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Platform following changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of The Commonwealth of The Bahamas. Any disputes shall be subject to the exclusive jurisdiction of the courts of The Bahamas.
